Court Upholds Oktoberfest’s Restriction to Munich Breweries

On January 17, 1990, the Munich Regional Court I upheld Oktoberfest’s restriction to established Munich breweries capable of supplying the festival reliably. The court considered the restriction justified by Oktoberfest’s identity as a festival of Munich beer. The dispute followed an attempt by Luitpold Prinz von Bayern to secure admission for beer produced by his Weiße Bräu company for the 1989 Oktoberfest. His unsuccessful challenge left the existing admission policy in place. The judgment reinforced the importance of Munich origin, brewing tradition, and dependable supply in determining which breweries could serve the festival.
